Seller's liability information

General conditions for the sale of new and used goods at Forestagri, regarding the seller's liability for defects in the sold goods.

 

I. Conditions for exercising the rights under the warranty granted by the Manufacturer of the goods

1. The Seller is not a guarantor of the quality of the goods. If the Manufacturer grants a quality guarantee, its terms are made available on the VAT invoice issued by the Seller. Warranty rights must be exercised in accordance with the conditions set out in the warranty document attached to the goods, taking into account the provisions below.

2. In order to benefit from the Manufacturer's warranty, the Buyer is obliged to notify the Seller directly about the defect in the goods within 2 days from the date of its disclosure. The notification should be made by telephone or via e-mail to the following address: [email protected] and - additionally - delivered to the Seller by registered letter with acknowledgment of receipt.

3. The costs related to shipment of goods under the warranty claim are borne by the Buyer, unless the warranty conditions provide otherwise. If the Manufacturer does not accept responsibility for the defect of the goods, all shipping costs will be borne by the Buyer, based on the debit note issued by the Seller.

4. If the goods are sent to the Buyer via a courier company, the Buyer is obliged to check the condition of the goods in the presence of the courier. If any defects are found, including those that may occur during transport, the Buyer is obliged to complete the report provided by the courier, which constitutes the basis for reporting to the Seller, under pain of losing warranty rights.

5. In the case of sales that are not consumer sales, the Seller's liability for defects in the goods under the warranty under the terms set out in the Civil Code is excluded.

 

II. Complaint against the courier company when choosing to collect the goods by courier

1. The goods may be delivered by personal collection by the Buyer at the Seller's office or by delivery via a courier company (distance sales). If the courier delivery option is used, delivery is made when the Seller entrusts the goods to a courier company for delivery to the address indicated by the Buyer.

2. In the event of loss, defect or damage to the shipment, which is discovered upon receipt, in accordance with point I.4. or delays in delivering the shipment by the courier, the Buyer may submit a complaint, also through the Seller, only to the courier company. The Seller may waive the Buyer's right to pursue claims arising from complaints.
